Texas Rule 37 Uninsured Motorist Rejection

Definition

Texas Rule 37 Uninsured Motorist Rejection refers to the requirement under Texas Insurance Code Section 1952.101 that every Texas auto insurance carrier must automatically include Uninsured and Underinsured Motorist coverage on a new auto policy unless the policyholder rejects it in a signed written statement. The law mirrors the regulatory pattern often called Rule 37 in industry shorthand and protects drivers from being silently sold a policy without UM/UIM. If no signed rejection is on file, the policy is presumed to include UM/UIM at the same limits as the bodily injury liability coverage. UM/UIM pays the insureds medical bills, lost wages, and property damage when the at-fault driver has no insurance or insufficient coverage. In the DFW area, where uninsured motorist rates remain elevated, A-LA strongly encourages drivers to keep UM/UIM rather than reject it, even when budgets are tight.
