Omitted Driver

Spanish: Conductor Excluido

Definition

Omitted Driver, sometimes called excluded driver, refers to a person living in the insured's Texas household who is intentionally excluded by written endorsement from the auto policy, meaning they are not covered while operating any vehicle on the policy. Texas carriers commonly require excluded-driver endorsements when a household member has a poor driving record — such as a DWI, suspended license, or multiple at-fault accidents — because including that person would make the policy unaffordable or unavailable. Once a driver is excluded, the carrier will deny any claim arising from that person operating an insured vehicle, leaving the household financially responsible for the full loss. Excluded drivers typically sign the endorsement acknowledging their lack of coverage. Excluding a driver is not the same as failing to disclose them; undisclosed household drivers can trigger claim denial and policy rescission. Excluded drivers can be re-added at renewal if their record improves.
