Definition

A Lapse in Coverage refers to any gap during which a driver has no active auto insurance policy, most commonly caused by missed premium payments or failure to renew at the end of a policy period. Even a single-day lapse is legally significant in Texas: TexasSure, the state's electronic insurance verification system, cross-references vehicle registrations against active policies, and an uninsured flag can trigger notices from the Texas Department of Motor Vehicles. Driving during a lapse is a Class C misdemeanor under Texas Transportation Code Chapter 601, with first-offense fines of $175–$350, license suspension, and possible vehicle impoundment. For drivers under an SR-22 requirement, a lapse triggers an SR-26 filing with DPS that can restart the entire compliance period. Lapses also drive future premiums higher because carriers classify lapsed drivers as higher risk. Setting up automatic payments or renewal reminders is the most reliable way to prevent a lapse.
