Proof of Insurance in Texas: Requirements

What counts as proof of insurance, when you need to show it, and what happens if you can't.

Texas accepts digital proof of insurance on your phone or tablet under Tex. Transp. Code §601.053 — an emailed card, the carrier's app, or a screenshot all work. You must show proof during traffic stops, vehicle registration, and state safety inspections. Failing to show proof is a Class C misdemeanor with first-offense fines of $175–$350 under §601.191, even if you actually have coverage. What Counts as Valid Proof

Insurance ID Card

The standard proof is your insurance ID card (paper or digital) showing your insurer's name, policy number, effective dates, insured vehicle info, and covered drivers.

Digital Proof on Your Phone

Texas Transportation Code Section 601.053 explicitly allows electronic proof of insurance. You can show your insurance card on your phone's screen during a traffic stop.

Insurance Policy Document

A copy of your full insurance policy or declarations page is also accepted as valid proof.

Penalties for No Proof

Even if you have active insurance, failing to show proof when asked is a Class C misdemeanor in Texas. First offense fines range from $175 to $350 plus court costs (Texas Transportation Code §601.191). Courts may dismiss the charge if you can show that you had valid coverage at the time of the stop. However, you'll still need to appear in court and may need to pay a dismissal fee. It's much easier to just keep your proof accessible.

When Texas Asks for Proof

In our DFW offices we walk through four common scenarios with new clients so they know what to expect. The first is the traffic stop. When an officer requests license and insurance, you have the right to hand them either a physical card or show the digital version on your phone. The officer will typically verify electronically through the TexasSure system regardless, but the law requires you to produce proof if asked.

The second scenario is vehicle registration renewal at your county tax office. Proof of current insurance is required before the clerk will issue new registration stickers — digital or paper both accepted. The third is the annual Texas state inspection (for counties still requiring it). Inspection stations verify active insurance before issuing the inspection certificate.

The fourth is after an accident. Texas law requires you to exchange insurance information with any other driver involved. A screenshot of your digital card is acceptable here, but we recommend having the information memorized or written down too — claim intake lines will ask for the policy number, which is harder to read off a stressed driver's phone.

The Escalation Path for Repeat Offenses

Texas takes a harder line on repeat violations of the proof requirement. First offense under Tex. Transp. Code §601.191 is $175–$350. A second or subsequent conviction for actually driving without insurance (not just failing to show proof) jumps to $350–$1,000, plus a $250 annual surcharge for three years under the Driver Responsibility Program (or the current surcharge replacement in effect), plus possible vehicle impoundment and registration suspension.

If your license was suspended because of an uninsured accident or repeat offense, you will need to file an SR-22 to reinstate it. The cheapest way to avoid all of this is simple: keep active Texas-minimum 30/60/25 coverage, carry digital proof on your phone, and shop your rate annually so the premium does not tempt you to let it lapse.

Where Drivers Slip Up

A few patterns we see frequently in our offices. The first: expired proof on the phone. A driver renews their policy, gets a new card, but never deletes the old screenshot. At a traffic stop they pull up last year's card, officer checks dates, and the fine is on the table even though current coverage is active. Fix: after every renewal, delete the old card image and save the new one.

The second: proof for the wrong vehicle. Clients add a new car to the policy, the old card still shows the previous vehicle's VIN. The officer flags the mismatch. Fix: request a new card any time you add, remove, or replace a vehicle — our team does this automatically, but if you bought elsewhere, you need to call in after every change.

The third: dead phone. A great digital card is useless on a phone with 0% battery. We recommend keeping a printed copy in the glove box as a safety net. Cost: nothing. Fines avoided: up to $350.
